Public Interest Assessment is no longer mandatory in Brazil in original dumping and subsidy investigations

SECEX Ordinance no. 237, published on March 08, 2023, made the assessment of public interest in original dumping and subsidy investigations optional.

As of March 15, 2023, interested parties may request the opening of the public interest assessment procedure in original dumping and subsidy investigations by submitting the information contained in the public interest questionnaire.

The public interest assessment may also be initiated ex officio   by   the Department of  Trade  Remedies (DECOM) of the Foreign Trade Secretariat (SECEX) of the Ministry of Development, Industry, Foreign Trade and Services (MDIC).

The change unified the public interest proceedings in the original investigations and in sunset reviews.

This is the first specific change in the public interest assessment proceedings by the new federal government and could be seen as an indication that there will be future changes in trade remedy proceedings, in Brazil.
